At the time and place regularly set, notice having been duly given, the following item was called up:
Hearing on proposed amendment to Title 22 - Planning and Zoning, to establish new case processing procedures and development standards for non-commercial wind energy conversion systems and temporary meteorological towers (All Districts); also approval of Negative Declaration (ND) and determination that the project will not have a significant effect on the environment, or adverse effect on wildlife resources and that the ND reflects the independent judgment of the County, as further described in the attached letter dated March 11, 2002 form the Director of Planning
Opportunity was given for interested persons to address the Board. Hank Zevallos, J. Edward Duggan, Curtis B. Cobb, and Ray Lembo, Sr. addressed the Board.
Supervisor Antonovich made a motion to instruct County Counsel to include a requirement in the proposed ordinance that a public hearing be conducted, rather than a Director's review if two or more protests are received.

Lee Stark, representing the Department of Regional Planning was duly sworn and testified on the aforementioned matter, and requested the Board's consideration of the following modifications to the draft ordinance in addition to the modifications included in the Board letter:
a. Remove the word "flashing" used to describe the lights that may be required on the towers;
b. Change the agency reference for approval of the types of machines that are acceptable to a "national or international standards-setting body", and at the same time require that the machine have at least one year of reliable operation history and have at least a five year warranty from the manufacturer; and
c. Change the minimum height of the blade tips above ground from 30 feet to 20 feet.
After discussion, on motion of Supervisor Antonovich, seconded by Supervisor Knabe, unanimously carried, the hearing was closed and the Board took the following actions:
1. Considered and approved the attached Negative Declaration together with any comments received during the public review process, and made a finding that on the basis of the whole record before the Board, there is no substantial evidence that the project will have a significant effect on the environment, and that the Negative Declaration reflects the independent judgment and analysis of the Board;
2. Approved the recommendation of the Regional Planning Commission to establish new case processing procedures and development standards for non-commercial wind energy conversion systems and temporary meteorological towers;
3. Determined that the Commission's recommendations are compatible with and supportive of the goals and policies of the Los Angeles County General Plan;

4. Made a finding that the adoption of the proposed amendments to Title 22 - Planning and Zoning of the Los Angeles County Code is de minimus in its effect on fish and wildlife resources; and authorized the Director of Planning to complete and file a Certificate of Fee Exemption for the project after adoption of said proposed ordinance; and
5. Instructed County Counsel to prepare an ordinance for adoption amending Title 22 - Planning and Zoning of the Los Angeles County Code with the following modifications presented during the hearing:
a. A requirement in the proposed ordinance that a public hearing be conducted, rather than a Director's review if two or more protests are received.
